This has been making the rounds of many forums. The facts are that the decision is being appealed and is of very narrow scope. It involves people "tresspassing on flooded land". This was at flood stage of the Mississippi River beyond the "Highwater mark".
I don't see why it has recieved the attention--except that perhaps an attorney wanted publicity. I don't see any risk for average boaters. I have owned waterfront property for many years, and one has to understand that the public has the right to transgress over your land up to the normal "high water" mark in most areas. This situation is almost like my house being flooded and the fishermen fishing in my living room!
