No more C-Dory Factory service, Seattle area

Thanks, Mark. I do recall that bit of info coming out before. Very interesting, and telling besides.

Now then - you got a minute? I and at least one other gentleman on here are very interested in whatever you might be able to share about the C-Dory 25' Cruise Ship made in '95-'96. Hull numbers 003 and 006 are owned by members here. Any idea where the others are? How many were made?

Thanks again.

Thanks for the explanation, Mark. Since you quoted me, let me say that I won't be the one to bring up anything about any boat other than my C-Dory from here on in. I love my boat and appreciate the part you and your family played in the design.

I am a passionate kind of guy (did I need to say that? ). I served on my national professional association's copyright board and have spent a good portion of my professional life doing my part to protect intellectual properties. I am now a retired guy and just wanna have fun. Perhaps I'll join Bill in holding hands and singing... and if I see something I don't like, I'll vote with my dollars.

Sincerely,
Jim B.

C-Dory Inc only built 5 of the 25’ C-Dory. Numbered 001 ~ 006. The others are, how shall say this, being built by C-Dory Marine Inc without license.

Please everyone feel free to debate. I just want to make sure you guys don't give away what I hadn’t sold.

Mark Toland President of C-Dory Inc.

Mark, this has confused me since the first time I saw it...perhaps you can enlighten us.

In your first post here, you stated the following when describing what you sold:

Mark Toland":1gbs915m said:
"Purchaser hereby agrees to purchase and seller agrees to sell business fixtures and equipment, (list attached hereto as exhibit 'A' and by reference incorporated herein), leasehold improvements, inventory and supplies, trade name, covenant not to compete, phone and fax numbers, and goodwill of the business known as C-Dory located at 25028 Pacific Highway South, Kent Washington 98032" and then added by pen and initialed was the line "Sale includes all rights to the trade name 'Tomcat.' "

Emphasis added by me, above.

I'm no lawyer, and I'm not trying to stir up the pot here, but with all due respect - the above seems pretty clear to me with respect to the C-Dory name. You appear to have sold it. Is it not the trade name the boat was marketed under when you owned the company?

If so, how are you able to refer to yourself as "President of C-Dory Inc."?

If not, what is the "trade name" you referenced in the sales agreement?

You are correct that I sold the C-Dory name to a new company that was formed to receive the assets that were purchased ~ C-Dory Marine Inc. I am not a part of that company. My old company was however still incorporated and still had assets and obligations. I do still represent the C-Dory cooperation and my title is still president. If I were to do business through this company I would have to use a DBA. However the only business of C-Dory Inc today is to protect its interests and fulfill past obligations as it prepares for its final farewell (hopefully at the end of this year). When I act in that capacity it is proper for me to properly identify myself.
