Someone made a mistake

Reminds me of recent military collisions on the other side of the world.

Navigation rules exist to prevent such happenings.

Human beings are fallible. Somebody messed up.

Stuff happens we want not to happen; part of the
human condition.

There is another thread on this collision. My comment there and here, is that most likely the "charter boat"--with a CG licensed skipper will be mostly at fault. There are a few factors which might mitigate his negligence, and that would be if the sailboat had its engine running and was showing the proper "Day Signal" for a boat with sails up but under power--the upside down cone.

Charter boat on auto pilot? Skipper was distracted. The power boat must have been going pretty fast to ride up over the sailboat, which is most likely totaled.
 
Calm seas, good visibility, no discernible traffic in area. This almost looks intentional. I mean come on! Look at all the people in cabin and no one saw the sailboat from at least half mile away?
