If you don't want viewers of a public forum to have the right to copy your images, then you must register the image with the U.S. Copyright Office before you post the image in a public place. If you have done so, you have legal recourse to sue, and no end of attorneys willing to take the case pro bono, because U.S. copyright law requires the offender to pay court and attorney fees, in addition to damages.

You have to show that you suffered some sort of economic harm to make the infringement case worth pursuing. Just because a few of your snapshots were used by someone else, doesn't mean you have a case that is worth the trouble.

Infringement case only really works for professional photographers, graphic artists, etc.

I just emailed the ad's owner and asked for more info. Let's see what comes back.

The seller, Ricardo, sent me a thoughtful, responsive email, a couple of days ago. Sorry I wasn't able to post it sooner. Ricardo wrote:

Thank you Andy,

While we are moving forward with all aspects of Cape Dory Cruisers and certainly the Cape Dory 220 Marinaut Pilot House Cruiser the process does take time and we are purposely taking the necessary time to assure that we produce top quality boats and timely deliveries. Regardless of what occurs the availability of any of the Cape Dory Cruisers will be limited.

We have purchase orders from select dealers and interest from retail customers as well. No matter where in the US boats are produced virtually every manufacturer is having difficulty finding employees. We have established a platform to begin manufacturing and hopefully to start delivering 2020 model year boats starting in July.

In previous years we were able to start producing 2020 model year boats earlier and ship as early as May-June. We recently learned however that the Coast Guard and NMMA changed the rules and now all manufacturers must wait until July 1 to ship 2020 boats. The boats may be started at any time but shipments must wait until the July 1 ruling date.

In actuality, we had planned to start producing and shipping in May-June and only recently learned of the new change by the Coast Guard and NMMA. All of this is fine as our consistent plan with Cape Dory is to take the necessary time and certainly not rush the production of the boats to be sure to maintain the quality and integrity of the brand.

In addition, the dealers that we are establishing and are in communication are not just long time business associates over several "decades" but personal and trusted friends. It is important that we proceed with the utmost caution and be sure to "Under Promise, and Over Deliver".

While we were planning our production over the last year we had a boat specified by a preferred customer and dealer and had permission to sell the boat directly if an opportunity was developed. Because of this we ran an ad in Craig's List to do some preliminary marketing and perhaps generate some "pre-sales". It is a common practice amongst boat manufacturers to market new model boats and generate pre-sales.

In fact, this is what Les did when he started the original Marinaut program. Les was able to actually sell 8 to 10 boats throughout North America with just internet and "word of mouth" advertising. A lot of which occurred through the C-Brats.

Our plans for the first quarter of 2019 were also shifted due to a late decision to attend the Miami Boat show and present our Cape Dory Catamarans that have been established as an imported product line along with Cape Dory Trawlers that are being manufactured in China. While the platforms for these products has been established this is also somewhat delayed due to Mr. Trumps 10% tariffs that he imposed last fall on China produced boats.. (See Attached Press Release from IBI and Soundings Only). While we are committed to manufacture the smaller boats here in America our other business activities help support the entire Cape Dory and other projects that we sometimes become involved.(See: madisonbayholdings.com)

I appreciate you reaching out and will send you and update at a later date. While I certainly respect and have had the pleasure to meet several of the C-Brats I have only made one post as I prefer to wait until we have more momentum and our operations are at a more advanced level. At that point we will look forward to keeping the C-Brats informed and hopefully becoming more active in the rendezvous and other events.

Kind Regards,

Ricardo

Less was able to do that because of his reputation with C-Dory owners, his presence here on C-BRATS, and his relationship with "OG" Dave Johnston(sp).

Hoping for a good future for Marinaut.
