Does anyone have a purchase and sale agreement for a C-Dory that I can use as a template?
Thanks! |

The TN form is not a purchase and sale agreement. Unless closing is anticipated to be at a later date, the bill of sale can relect necessary terms for seller including purchase price and limitations on warranty - "as is without warranty, express or implied" or what warranties are bieng made. It should include a complete description of property being sold, including a detailed list of included equipment and appuratances (along with Hull id no. and other serial numbers) and hours on engines.
A purchase and sale agreement is more complicated, and if the transaction irequires one, you may want to seek legal advice. |

Good morning:
I did a quick search and found these two:
The first was at
http://www.boatus.com/trailerclub/BuyingtheRightUsedBoat.asp
A Purchase Agreement Should Contain:
• Date
• Name of purchaser and (if applicable) co-purchaser, their address and phone number
• Name of seller and co-seller, their address and phone number
• Broker (if applicable) If a broker is used, they will provide the purchase agreement
• Description of boat, including:
• Manufacturer
• Model
• Year
• Length
• Hull #
• Engine #
• Trailer Documentation # (manufacturer, model, year, and serial number, if applicable)
• Location of boat
• Selling price and terms/conditions of purchase
• Deposit received $ _______ and date the deposit was received _______
• Closing date
• Liens of encumbrances (the boat is sold free of any liens, bills unless otherwise stated and agreed to. The owner warrants that he has a marketable title and the lawful right to sell the boat (and trailer if appropriate) and will deliver all the necessary documents for the transfer of title.)
• Additional terms and conditions:
• Transaction is subject to acceptable survey
• Sea trials and (if applicable) financing
• The boat must be insurable
• The deposit is refundable in full to the purchaser if any of the above items are unsatisfactory.
• Copies of current state title and registration and current certificate
of documentation (if applicable) should be attached to this agreement.
The second actually had an example, too long to cut and paste, so here is ths address:

Hope this is what you are looking for.

WOW... These seem way complicated... I have sold several personal cars, boats, motor cycles and have basically used the following and it has worked for both parties...who just wanted to exchange some funds and ownership. Each states AND within some counties documentation process is a bag of worms of it's own. This has worked for me...with no lawyers and many happy new owners. I have used this to buy and sell items... just a thought.

Thank you all for the info. I can put something together from what has been offered here and the links.
It is with mixed emotions that I am selling this boat. I am just not using the boat enough and I hate seeing it just sitting there. The boat deserves better.

Hey Don! Just now realized you were in TN... Sorry you have not been able to join us on the Cumberland for any of our C-Brat gatherings. Best of luck selling your boat.

Hi! Byrdman. Perhaps had I joined some of the gatherings, I wouldnt be selling the boat. I just found I wasnt using it enough. Part of the problem is a medical issue and part was I dont have anyone to enjoy the boat with. The wife just doesnt like boating and whenever I took the boat out, I was alone. While sometimes the solitude was great, I also found that sharing the experience with someone would have made it more fun too. At least for me.
Regards, |
